The Criminal Code of the Republic of Kazakhstan provides for two types of crimes: related to bribes:
- receiving a bribe (Article 311);
- giving a bribe (Article 312).
These are two sides of the same criminal coin: if we are talking about a bribe, it means that there is someone who takes the bribe (bribe-taker) and someone who gives it (bribe-giver).
Receiving a bribe
One of the most dangerous official crimes, especially if it is committed by a group of persons or is accompanied by extortion, which consists in the receipt of advantages and benefits by an official for legal or illegal actions (inaction).
Giving a bribe
A crime aimed at inducing an official to commit lawful or unlawful acts (inaction), or providing, receiving any benefits in favor of the donor, including for general patronage or connivance in service.
Bribe is understood as:
- Subjects - money, including currency, bank checks and securities, precious metals and stones, cars, food, videoTechnicianа, household appliances and other goods, apartments, dachas, country houses, garages, land plots and other real estate.
- Services and benefits - treatment, repair and construction work, sanatorium and tourist specialist vouchers, trips abroad, payment entertainment and other expenses free of charge or at a reduced cost.
- Concealed form of bribe - a bank loan or under the guise of repayment of a non-existent debt, payment for goods purchased at reduced price, purchase of goods at an inflated price, conclusion of fictitious transactions that do not actually entail the creation of assets, services performed for free or at a reduced cost.

Who can be held criminally liable for receiving a bribe?
A bribe-taker may be recognized as an official authorized to performance of state functions, and a person equated to it.
Persons holding a responsible state position are persons holding a positions established by the Constitution of the Republic of Kazakhstan, constitutional and other laws of the Republic of Kazakhstan for the direct performance of functions state and the powers of state bodies.
